New Title IX suit filed against Indiana University

INDIANAPOLIS -- A former student at IU-Bloomington filed suit Thursday against the university, Delta Tau Delta fraternity and its Bloomington chapter.

The complaint alleges a Title IX violation based upon the female student's sexual assault in April 2015 by John Phillip Enochs, a former IU-Bloomington student and member of Delta Tau Delta.

Enochs had also been accused of sexual assault by another female student in October 2013.  

He was charged with two counts of rape in September 2015 based upon the two incidents.

The complaint states:

Indiana University Bloomington officials and administrators showed deliberate indifference to actual notice of this sexual assault and condoned Delta Tau Delta fostering an environment of illegal and dangerous activity, as well as sexual assault.

It goes on to say that Delta Tau Delta ignored Enochs's history of sexual assault and failed to put in place measures to protect a 'foreseeable' sexual assault at Delta Tau Delta social event at the fraternity house.
